The agreement
These terms are a contract between you and Clatos Technologies Private Limited. They apply the moment you create an account, use the workspace, or pay us anything — whichever happens first.
Our Privacy Policy and Disclaimer are part of this agreement. Where a signed order form or enterprise agreement says something different, that document wins.
Who can use it
- You must be at least 18 and able to enter a contract.
- If you’re signing up on behalf of a business, you must be authorised to bind it — “you” then means that business.
- You must not be barred from receiving our services under any law that applies to you.
- One human, one login. Accounts are not shared; add users to the workspace instead.
Your account
You’re responsible for what happens under your login, including anything your team does. Keep the password to yourself, turn on whatever extra protection we offer, and tell us fast if something looks wrong.
The details you give us have to be accurate, and you have to keep them current — particularly the billing email, since that’s where invoices and renewal notices go.
Plans, credits and add-ons
- Plans
- Free, Pro, Max and Custom. A plan sets your ceilings — contacts, users, storage, included credits — and the apps you can switch on.
- Credits
- The metered unit. A verified lead is 1 credit, an AI draft or lead score is 2, an automated message is 0.25. Everything else in your plan — contacts, boards, dashboards, users — never touches credits.
- Plan credits
- Included with the plan and reset on each billing date. They do not roll over.
- Top-up credits
- Bought separately. They never expire and are consumed only after the month’s plan credits are gone.
- Add-ons
- WhatsApp Suite and Catalogue, priced per workspace, as the plans are. They attach to any plan including Free, and cancel independently of it.
Prices are listed on the pricing page. We can change them, but not mid-term: an increase applies from your next renewal and we’ll email you at least 30 days before it does. Carry on and you’ve accepted it; cancel before the renewal and you never pay it.
Billing
- Subscriptions bill in advance — monthly on the same date each month, annually on the same date each year.
- Prices are in Indian Rupees unless your invoice says otherwise. GST is added where applicable.
- Subscriptions renew automatically until cancelled. You can cancel from Settings at any time, and it takes effect at the end of the period you’ve already paid for.
- If a payment fails we’ll retry and email you. After 7 days the workspace goes read-only; after 30 it may be suspended. Nothing is deleted while it’s suspended.
- Credit top-ups are charged immediately and are not part of the subscription.
Refunds
Payments are non-refundable. That includes the unused part of a billing period you’re leaving, and credits you have already spent — a spent credit is work that already happened, and we can’t un-spend it.
This is the reason the Free plan exists and has no time limit on it. Nobody should have to pay to find out whether Clatos fits: stay on Free for as long as you need to, and only put money in once you’re sure.
Cancelling stops the next charge rather than returning the last one. You keep the plan until the end of the period you’ve paid for, then drop to Free rather than to nothing, and your data stays where it is.
A billing mistake is not a refund request and isn’t covered by any of the above. A duplicate charge, the wrong plan, the wrong amount, or a charge that landed after you cancelled — tell us at [email protected] and we put it right.
Where the law gives you a refund right that this section doesn’t, the law wins and we’ll honour it.
What you can’t do with it
Don’t use Clatos to:
- Send unsolicited bulk messages, run a scam, phish, or impersonate someone.
- Break any law that applies to you or to the people you’re contacting.
- Upload malware, or anything that infringes someone else’s copyright, trademark or privacy.
- Reverse-engineer, resell, sublicense or white-label the service without a written agreement from us.
- Probe, load-test or attack the infrastructure, or work around rate limits, credit metering or plan ceilings.
- Scrape the product, or use bots against it outside a documented API.
- Store the sensitive categories of personal data our Privacy Policy asks you not to.
Sending spam through Clatos is the fastest way to lose the account. It gets our sending infrastructure blocked, which harms every other customer.
Outreach is your responsibility
Clatos hands you leads and the means to contact them. Whether a given message is lawful depends on who you are, who they are and what you say — which are all things only you know. So:
- You are the sender. You need whatever consent the law requires for the channel you’re using.
- You must honour India’s DND registry and TRAI’s commercial-communication rules, and the equivalent rules anywhere else you send.
- WhatsApp sending is additionally governed by Meta’s Business and Commerce policies. Break those and Meta can restrict your number — that’s between you and Meta, and we can’t reverse it.
- Honour opt-outs immediately, on every channel.
- The source link on a lead is there so you can verify it. Using a record you haven’t checked is a choice you’re making.
If a complaint, penalty or claim lands on us because of a message you sent, the indemnity below applies.
Your data stays yours
You own everything you put into Clatos. You grant us only the licence we need to run the service for you: to store it, back it up, transmit it, display it back to you, and process it through the features you switch on. Nothing wider than that.
You can export to CSV at any time, on any plan, including while the account is being closed. We don’t hold data hostage as a retention tactic.
You confirm you have the right to put into Clatos whatever you put into it, and that doing so doesn’t breach anyone’s rights.
Availability, support and changes
- We aim for high availability but we don’t promise uninterrupted service on the standard plans. Uptime commitments exist only where a signed agreement gives you one.
- Planned maintenance is announced in advance and scheduled for low-traffic hours wherever we can.
- Support is by email, in English and Hindi, during business hours. Response targets vary by plan.
- We improve the product continuously, which means features change. If we retire something you depend on, we’ll give you at least 30 days’ notice and a migration path.
- Beta features are labelled as such. They can change or disappear without notice and carry no commitments at all.
Who owns what
The software, the interface, the brand, the name Clatos and everything we’ve written belong to Clatos Technologies Private Limited. Your subscription buys the right to use it, not to own any part of it.
If you send us feedback or an idea, we can use it to improve the product without owing you anything for it. That’s not us claiming your business ideas — it just means we don’t have to track who suggested a better button.
Ending it
You can cancel whenever you like, from Settings, in about four clicks. Downgrades and cancellations take effect at the end of the billing period. Your data stays put until you delete it or the retention window in the Privacy Policy runs out.
We can suspend or close an account for non-payment, for a serious or repeated breach of the acceptable-use section, or where the law forces our hand. Except where there’s a legal or safety reason not to, we’ll warn you first and give you a chance to fix it, and you’ll always get the chance to export.
Warranties
The service is provided “as is”. Beyond what these terms say and what the law won’t let us exclude, we don’t make any other warranty — including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
We don’t warrant that the service will be uninterrupted or error-free, that lead data will be complete or accurate, or that using Clatos will produce any particular commercial result. The Disclaimer covers this in more detail.
Limitation of liability
To the fullest extent the law allows, neither party is liable to the other for indirect, incidental, special or consequential loss — including lost profit, lost revenue, lost business or lost data — even if it was foreseeable.
Our total liability for any claim connected to Clatos is capped at the amount you actually paid us in the 12 months before the claim arose. On the Free plan, that amount is zero, and the cap is the total of any fees paid for add-ons or credits.
Nothing here limits liability for fraud, wilful misconduct, or anything else the law says cannot be limited.
Indemnity
You’ll cover us against claims, penalties and reasonable legal costs arising from your use of Clatos in breach of these terms — most commonly, messages you sent that you weren’t entitled to send, or data you uploaded that you weren’t entitled to hold.
Governing law
These terms are governed by the laws of India. The courts at Bengaluru, Karnataka have exclusive jurisdiction.
Before either of us goes near a court, we both agree to spend 30 days trying to sort it out by talking. Write to [email protected] and a human will answer.
Changes to these terms
We’ll email account holders at least 14 days before any material change takes effect, and the date at the top of this page will move. If you don’t agree with a change, cancel before it lands — continuing to use Clatos after it does means you’ve accepted it.
